These Terms & Conditions ("Terms") govern your access to the True Blue IT Services website and your use of the products and services we provide. By using our website, requesting a quote, or engaging our services, you agree to be bound by these Terms.
In these Terms, "True Blue", "we", "us" and "our" refer to True Blue IT Services (ABN 95 664 282 893). "You" and "the client" refer to the person or organisation accessing our website or engaging our services. If you do not agree with these Terms, please do not use our website or services.
True Blue provides technology products and services which may include, but are not limited to:
The specific services provided to you will be described in a quote, proposal, statement of work, or subscription agreement, which forms part of these Terms.
Microsoft licences are supplied and administered through True Blue as an authorised reseller (CSP). The following terms apply to all Microsoft licences obtained through True Blue.
Other recurring services — such as managed IT plans, hosting, website care plans, digital marketing retainers and CRM subscriptions — also renew automatically for successive monthly or annual periods (as applicable) unless cancelled in writing before the renewal date. We will endeavour to notify you ahead of significant changes to recurring fees.
While we apply industry best practice, we do not guarantee specific outcomes such as search rankings, traffic volumes, leads or conversions, as these depend on factors outside our control. Advertising spend is additional to our service fees and is charged by the relevant platform. Campaigns are subject to the terms of the third-party platforms on which they run.
Where we arrange hosting, domain names or other third-party services on your behalf, these are subject to the providers' terms, availability and renewal cycles. We do not warrant uninterrupted or error-free service from third-party providers. Domain and hosting renewals may also be set to renew automatically to avoid loss of service.
All intellectual property in materials we create remains our property until we receive full payment, at which point ownership of the agreed deliverables passes to you. You grant us a licence to use content, logos and materials you supply for the purpose of delivering the services, and to reference completed work in our portfolio and marketing unless you request otherwise in writing.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits or excludes those rights. Subject to those rights, we provide our services with due care and skill, and manufacturer warranties apply to hardware we supply. Other than as required by law, our services and any third-party products are otherwise provided "as is".
To the maximum extent permitted by law, and other than for liability that cannot be excluded, our total liability arising out of or in connection with the services is limited, at our option, to re-supplying the services or paying the cost of having the services re-supplied. We are not liable for any indirect, special or consequential loss, or for loss of profits, data or business.
Each party agrees to keep the other's confidential information secure and to use it only for the purpose of the engagement. Our handling of personal information is described in our Privacy Policy, available on our website.
Subscriptions and recurring services may be cancelled in writing before the next renewal date, subject to any committed terms (including Microsoft licence terms in section 4). Deposits and fees for work already performed are non-refundable. Refunds, where they apply, are provided in accordance with your rights under the Australian Consumer Law.
Either party may terminate an engagement in accordance with the applicable agreement or where the other party is in material breach and fails to remedy it within a reasonable time. On termination, you remain liable for services provided and any committed subscription terms up to the effective date of termination.
We may update these Terms from time to time. The current version will always be published on our website with its effective date. Your continued use of our website or services after changes are published constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Northern Territory, Australia, and you submit to the non-exclusive jurisdiction of the courts of that Territory.
